These Terms and Conditions govern your use of tendthetech.com and all software tools, platforms, and services provided by Tend the Tech, including StreetRank. By visiting our site, creating an account, or purchasing services, you agree to these terms. ## 1. Services provided Tend the Tech provides managed digital operations, software platforms, and search engine optimization tools for businesses. Our services include website design and hosting, search ranking audits, reputation monitoring, and custom integrations. Detailed terms for specific project work or monthly maintenance plans are set forth in our separate Service Agreement. ## 2. Account registration and security To use our hosted software applications, you must register for an account and provide accurate contact and business information. You are responsible for safeguarding your login credentials and for all activities that take place under your account. Notify us immediately at ops@tendthetech.com if you suspect unauthorized access. ## 3. Acceptable use You agree to use our site and tools only for lawful business purposes. You agree not to: - Attempt to probe, scan, or compromise our infrastructure or security controls. - Use automated scrapers, bots, or unauthorized scripts to extract data from our platforms outside documented APIs. - Interfere with or disrupt the normal operation of our services for other users. - Transmit malicious code, viruses, or unsolicited promotional communications through our platform. ## 4. Third-party integrations (Google, AI providers) Our tools let you connect Google Search Console and Google Analytics. When you use StreetRank's in-app chat, the data it looks up for you is sent to the AI providers named in our [Privacy Policy](https://tendthetech.com/privacy/). By authorizing an integration, you grant us permission to access data as needed to deliver reporting and insights. Your use of third-party platforms remains subject to each provider's own terms and policies. We are not responsible for availability or policy changes made by third-party platforms. ## 5. Intellectual property and data ownership You retain all ownership rights to the content, customer lists, and business data you provide or connect to our platform. Tend the Tech owns all intellectual property rights in our software, user interfaces, branding, custom scripts, and underlying architecture. ## 6. Fees and payments Fees for our software subscriptions, setup packages, and custom work are stated on our pricing pages or in individual invoices. Invoices are due upon receipt. We reserve the right to suspend access to hosted software tools if account fees remain overdue. ## 7. Disclaimers and limitation of liability Our software and services are provided "as is" and "as available" without warranties of any kind, whether express or implied. Search rankings, traffic volumes, and business results depend on multiple external factors outside our control, and we make no guarantee of specific business outcomes. To the maximum extent permitted by law, Tend the Tech will not be liable for any indirect, incidental, or consequential damages arising from the use of our site or tools. Our total liability for any claim under these terms is limited to the amount paid by you to Tend the Tech in the twelve months preceding the event. ## 8. Termination You can stop using our services at any time. To close your account, email [ops@tendthetech.com](mailto:ops@tendthetech.com). We may suspend or terminate your account if you violate these terms or fail to pay applicable service fees. When your account ends, your right to use the platform ends. To have your data and stored Google tokens deleted, email us. Deletion is by request and done by hand, as section 5 of our [Privacy Policy](https://tendthetech.com/privacy/) describes. ## 9. Governing law These terms are governed by the laws of the State of California, without regard to conflict of law principles. Any dispute arising under these terms will be resolved in the state or federal courts located in Santa Clara County or San Mateo County, California. ## 10.
